Privacy statement Bolsius

  1. Processing personal data

In this Privacy Statement you can find information about the processing of personal data by Bolsius International B.V., Bolsius Nederland B.V. and Bolsius B.V. (hereinafter “Bolsius”, “we” or “us”). This Privacy Statement applies to all personal data processed by or on behalf of us when you are our customer, supplier or business relation, when you visit our websites, when you apply for a job at Bolsius, when you fill out our contact form or when you otherwise provide personal data directly to Bolsius. When processing personal data, we are highly committed to protecting your privacy.

When you visit our websites (www.bolsius.com and www.werkenbijbolsius.nl), our web servers store the IP address of your Internet service provider, as well as the website from which you visit us, the pages you access on our website and the date, as well as the duration of your visit. This information is absolutely necessary for the technical transmission of the web pages and for the secure and correct operation of the server. No personalized evaluation takes place. Later on in this Privacy Statement we explain more about the use of cookies by our websites.

Data that reaches us through the contact form, first name, last name and e-mail address, are stored on our servers during data backup. Your data will only be used to process your application, treated as strictly confidential and not passed on to third parties, unless this is strictly necessary for processing your application. If you apply for a job at Bolsius, Bolsius only processes those data that are necessary to complete the application procedure. Naturally, Bolsius will treat these data with strict confidentiality. The personal data are processed in accordance with the General Data Protection Regulation (hereinafter “AVG”) and other applicable privacy regulations.

If you are our customer, supplier or business relation, we may process the following data from you: first name, last name, telephone number, fax number, bank account number, e-mail address and job title.

Among other things, we process the following personal data from job applicants:

  • first name;
  • last name;
  • telephone number;
  • e-mail address and e-mails;
  • address;
  • gender;
  • date of birth/birth data;
  • curriculum vitae (CV)/motivation letter;
  • educational and working level;
  • Number of years of experience.

  1. Role of Bolsius

We are a data controller as defined by the AVG with respect to your personal data that Bolsius processes online. This means that we have certain legal duties and responsibilities for our processing activities. This Privacy Statement serves to inform you about what data we process and how we comply with our duties and responsibilities.

  1. Purpose and basis of processing personal data

We process these data for the following purpose:

  • in order to agree and/or execute orders (or have them executed);
  • to handle deliveries and purchases of our products and services;
  • to handle payments;
  • to inform you about our services and other activities (for example via e-mail, newsletters and company magazines) and to make you offers;
  • to handle disputes;
  • to comply with applicable laws and regulations;
  • to recruit and select new staff;
  • for the purpose of conducting data analysis and customer satisfaction surveys;
  • to carry out our administration in the broadest sense, and;
  • to comply with a legal duty.

 

Your personal data may also be processed when justified:

  • In the interests of State security;
  • For the prevention, detection and prosecution of criminal offences;
  • For important economic and financial interests of the State and other public bodies;
  • For the protection of the rights and freedoms of others; and;
  • For the supervision of compliance with statutory regulations established for the purpose of investigation and prosecution of criminal offences or for important economic and financial interests of the State and other public bodies.

The legal basis for processing this data is:
When you use our services, you are our supplier or we otherwise cooperate with each other, we process your personal data for the performance of the agreement we have entered into.

 

It may also be that Bolsius has a legitimate interest in processing your personal data. Think of direct marketing interests in selling new or different products. However, Bolsius will make a proper balancing of interests in each situation between safeguarding your privacy on the one hand and the legitimate interest of Bolsius on the other. Only if the legitimate interest of Bolsius outweighs your freedom and privacy rights, your personal data be processed on that basis.

 

Bolsius also has a legitimate interest in processing applicants’ personal data. This legitimate interest lies in the fact that processing the personal data is necessary for Bolsius to be able to go through the application procedure and assess whether the applicant is suitable for the position for which he or she has applied. If the applicant voluntarily shares more personal data than is necessary for the careful completion of the application procedure, these personal data are in principle not included in the judgement on whether or not the applicant will be hired.

 

Furthermore, Bolsius processes personal data pursuant to a legal obligation, such as its duty to keep records and to adhere legal retention periods.

 

In all other cases, Bolsius explicitly requests consent for the processing of your personal data. If you have consented to the processing of your personal data, you are always free to withdraw this consent.

Our website uses cookies, which store technical information. Cookies are small information files that a website leaves on your device, tracking your activities within our website. They include, for example:

Bolsius has entered into a processing agreement with Google for the use of Google Analytics. This agreement ensures that Google Analytics’ cookies are set in the most privacy-friendly manner. Bolsius has not given Google permission to use information obtained through it for other Google services.

 

Disabling

Most browsers will give you the option to refuse the use of cookies or to ask your permission each time a server wishes to place a cookie on your computer. If you do not allow the use of cookies, it may affect the usability of the website, or some parts of the website may not be accessible to you.

 

Social media

Bolsius uses social media for marketing purposes. Our websites include buttons and/or links to promote or share web pages on social (media) networks or third-party websites, such as Twitter, LinkedIn or Facebook. Bolsius does not monitor and is not responsible for the processing of your personal data by and through such third parties. The use of these social media is at your own risk. Before using third party services, it is advisable to read the Privacy Statement of these third parties.

  1. Security and recipients of your data

Security of your data

We have implemented technical and administrative security measures to protect your personal data from loss, destruction, manipulation and unauthorized access. All our employees, as well as the service providers operating on our behalf, are bound by the applicable legislation on the protection of your personal data. The basic principle in the processing of your personal data is data minimization; we process as little personal data as possible and only those persons at Bolsius who must have access to your personal data by virtue of their position.

 

When we collect and process personal data, The data is encrypted before it is transferred. This means that your data cannot be misused by third parties. Our security measures are constantly being improved and our Privacy Statements updated accordingly. Please make sure you have the latest version of the Privacy Statement.

 

If you suspect that your personal data is not adequately secured or there are indications of unauthorized use, please inform us immediately using the contact details provided in this statement.

 

Recipients of your data

Your personal data may be provided by us to the following categories of recipients:

  • Those charged with or necessarily involved in the execution of the agreement;
  • Those charged with or necessarily involved in communicating with you;
  • Others, if you have given your unambiguous consent;
  • Others, if the data processing is necessary for the fulfilment of a legal duty by Bolsius;
  • Others, if the data are processed (exclusively) for statistical or historical purposes.

 

A processing agreement is concluded with third parties who process your personal data on behalf of and at the instruction of Bolsius, as a result of which those third parties are also obliged to comply with privacy legislation. Third parties engaged by Bolsius, which offer services as processors, are themselves responsible for compliance with privacy legislation for the (further) processing of your personal data.

  1. Retention period of your personal data

In principle, we do not retain your personal data longer than necessary (after the end of the cooperation, for example) to fulfill the purposes described in this Privacy Statement, or than required by laws and regulations.

Applicants

If the applicant is hired for the position he or she applied for, the employer will retain the personal data for the duration of the employee’s employment and the retention periods applicable to the personnel file.

 

If the applicant is not hired for the position he or she applied for, Bolsius will delete the personal data no later than four weeks after the end of the application process. The applicant can give permission to keep his or her data longer (with a maximum of one year), for example because a suitable position at Bolsius may become available at a later date.

Please contact us at any time if you want to know what personal data we store about you or if you want it rectified or deleted. In addition, you have the following rights:

Right to receive information (art. 12-14 AVG)
You have the right to be informed about the processing of your personal data. This Privacy Statement provides this information. Should you require further information you can request this from us.

Right of inspection and access (art. 15 AVG)
You have the right to inspect the personal data we collect and store about you. This inspection also includes information about the purposes for which the personal data are processed, how long and where they are kept, and who receives the personal data.

Right to rectification (art. 16 AVG)
We do our best to ensure that the personal data we process is accurate and complete. Should you nevertheless believe that your personal data is incorrect or incomplete, you may request that your personal data be supplemented or amended.

Right to erasure (art. 17 AVG)
In certain situations, you have the right to have your personal data erased. This is the case, for example, if the data have been processed in violation of legal frameworks or if the personal data are no longer necessary for the purpose for which they were collected and stored.

Right to restriction of processing (art. 18 AVG)
You can have the processing of your data suspended for a certain period of time under circumstances. This can be done, for example, in the situation where you question the accuracy of the data, or because you consider that the personal data is no longer necessary for the purpose for which it was collected and kept. This right does not prevent us from continuing to process your personal data. We will let you know when the restriction is lifted.

Right to data portability (art. 20 AVG)
You may request personal data that we hold about you in certain cases in a structured, common and machine-readable form. After receiving the personal data, you are free to transfer this information to third parties.

Right to object to processing (Art. 21 AVG).
Unless we have a compelling, legitimate reason for processing, we will no longer process your personal data if you submit an objection.

Right to withdraw your consent (art. 7 AVG)
Where data processing is based on your consent, you have the right to revoke the granted consent at any time. Upon receipt of your request, we will immediately stop the processing of your personal data for which you had granted consent. The withdrawal of consent does not affect the lawfulness of the processing operations preceding that moment.

Complaints
Finally, we inform you that you have the right to lodge a complaint about our processing of your personal data with the Personal Data Authority if your complaint has not been or is not dealt with by us to your satisfaction.

Please contact us directly in these cases. Please note that in some cases your rights are not absolute and we may not be obliged to comply with your request. These rights cannot be exercised with respect to personal data processed by us for journalistic purposes. Furthermore, we cannot delete your personal data, for example, if we are required by law to retain it or if we retain it in connection with an agreement with you. Similarly, access to your data may be denied if making the information available would disclose personal data of someone else or if it is not legally permissible to disclose such information. We will always assess on a case-by-case basis whether this should be implemented and will inform you accordingly. Finally, if you withdraw your consent, we may have another legal basis under which we may still continue to process the personal data.

  1. Transfer to other countries

Your personal data will not be transferred to countries outside the EU or EEA.
